When is it necessary to use a label?
When is it necessary to have a label on the goods imported into the RA at different stages of alienation? We applied to the SRC for information on the labeling procedure. Below are the examples they provided.
Example 1
The RA resident Company carries out vehicle maintenance activities and in February 2018 it imported a product under the code 2710 19 820 0 CN FEA which is a refined petroleum product (hereinafter referred to as product). The product was imported in barrels and entered into the warehouse of the company, from which no alienation of products is carried out. The company transports the required quantity of goods by means of a measuring jug (equipment) owned by the company based on the demand from the barrel to the point of sale (showroom), where the alienation of the product is carried out by means of a measuring jug (equipment) owned by the company for the purpose of vehicle maintenance.
Example 2
The RA resident company carries out vehicle maintenance activities and in February 2018 it imported a product under the code 2710 19 820 0 CN FEA which is a refined petroleum product (hereinafter referred to as product). The product was imported in barrels and entered into the warehouse of the company, from which no alienation of products is carried out. The company transports the required quantity of goods by means of a measuring jug (equipment) owned by the company based on the demand from the barrel to the point of sale (showroom), where the alienation of the product is carried out by means of a measuring jug (equipment) provided by the buyer.
What is the procedure for labeling the goods imported into the RA in the described cases?
Pursuant to Article 390(2) of the Code the existence of a label on goods produced in the territory of the Republic of Armenia or imported into the Republic of Armenia, bottled or otherwise containerized (packaged), and prescribed by part 1 of this Article shall be mandatory at any stage of alienation within the territory of the Republic of Armenia, where these goods are alienated or consumed in the same container (package) and marketable condition without changing the weight (volume).
In case of changing the marketable condition of the imported oil or making other containerization is it necessary to have a label?
In both of the cases described, the goods imported by the organization are alienated from a container (packaging) other than the import container (packaging) and by changing the weight (volume) of the marketable condition and consequently it is not subject to labeling. However, it must be taken into account that if the organization alienates imported oil in the imported containers or the imported oil is containerized and alienated in containers of different capacity, the imported containers or those containers of different capacity are to be labeled.
